SMS Terms and Conditions
ManzerTech uses text messaging to communicate with clients on topics
relevant to their relationship with ManzerTech. For example, you may receive
updates related to your appointments/visits, support requests and updates
related thereto, account, one-time passcode, billing notifications, reminders,
and service management. Client information used for text messaging will not be
shared for marketing purposes.
PLEASE NOTE: THESE TERMS CONTAIN AN AGREEMENT TO RESOLVE ANY DISPUTES
THROUGH BINDING ARBITRATION WITHOUT JURY TRIAL AND A CLASS ACTION WAIVER, AS
DETAILED IN THE "RESOLVING DISPUTES" SECTION, BELOW.
By agreeing to participate in the ManzerTech text messaging program, I
agree and understand the risks associated with sending and receiving my
information via SMS/MMS text messages and that such electronic communications
may not be secure. I understand that consent is not a condition of any services
to be provided by ManzerTech, that I can opt out at any time by texting STOP to
1.949.484.8483, and that use of my information for the ManzerTech text
messaging program is subject to the ManzerTech authorization (when applicable),
terms and conditions, and Digital Privacy Policy. Usage of the ManzerTech text
messaging program shall comply with the guidelines contained in Exhibit A.
Your wireless carrier's Message and Data Rates may Apply to SMS
correspondence. ManzerTech does not charge for any content; however,
downloadable content may incur additional charges from your wireless carrier
depending on your selected plan. You are solely responsible for any fees,
including web access and/or data or text message charges that may be billed by
your wireless carrier based on your individual plan. Please contact your
wireless carrier for information about your messaging plan. Your carrier may
impose message or charge limitations on your account that are outside of our
control. All charges are billed by and payable to your wireless carrier.
You represent that you are the owner, or authorized user of the wireless
device and phone number you use to receive the service, and that you are
authorized to approve the applicable charges.
Message frequency may vary.
ManzerTech will not be liable for any delays or failures in your receipt
of any SMS messages as delivery is subject to effective transmission from your
network operator and processing by your mobile device. SMS message services are
provided on an as is, as available basis.
Data obtained from you in connection with this SMS service may include
your mobile phone number, your carrier's name, and the date, time, and content
of your messages and other information that you may provide. As described in ManzerTech's [hyperlink privacy policy here], we may use this information to
contact you and provide information about ManzerTech' services, or surveys
about how we could improve our offerings. Your wireless carrier and other
service providers may also collect data from your SMS usage, and their
practices are governed by their own policies. We reserve the right at all times
to disclose any information as necessary to satisfy any law, regulation, or
governmental request, to avoid liability, or to protect our rights or property.
When you complete forms online or otherwise provide us with information in
connection with the service, you agree to provide accurate, complete, and true
information.

Resolving Disputes
PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR
LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A
JURY HEAR YOUR CLAIMS.
In the event that there is a dispute between you and ManzerTech relating
to ManzerTech text messaging communications, arising out of any matter,
including in connection with any federal or state statutory provision or the
determination of the scope or applicability of this Agreement to arbitrate,
such dispute will be resolved by arbitration in California before one
arbitrator. The arbitration will be administered by the American
Arbitration Association (AAA). The arbitrator will apply the substantive
law of the State of California, exclusive of its choice of law rules. To
the fullest extent permitted by law, each of the parties agrees that any
proceeding will be conducted only on an individual basis and not in a class,
consolidated or representative action. The decision of the arbitrator
will be final and binding on the parties and will not be subject to appeal or
review. If for any reason a dispute proceeds in court rather than through
arbitration, each party knowingly and irrevocably waives any right to trial by
jury. The arbitrator will deliver a reasoned written decision with
respect to the dispute. The parties acknowledge that this agreement
evidences a transaction involving interstate commerce. Notwithstanding the
provision in this paragraph with respect to applicable substantive law, this
arbitration agreement will be governed by the Federal Arbitration Act, 9 U.S.C.
§§ 1, et seq.
Carriers are not liable for delayed or undelivered messages. Message and
data rates may apply for any messages sent to you from us and to us from you.
